Subdivision and Development Appeal Board

The Subdivision and Development Appeal Board (SDAB) is a quasi-judicial board independent of the Planning and Development Department of Lac La Biche County.  The SDAB hears appeals of the decisions of the Development Authority and the Subdivision Authority and of Stop Orders.

The Subdivision and Development Appeal Board is established under the Municipal Government Act, and the County’s Subdivision and Development Appeal Board Bylaw (Bylaw 21-007).  A copy of the Municipal Government Act can be obtained from the Alberta Queen’s Printer. 

Considering an Appeal

An appeal can be filed for a decision on a subdivision application, development permit application or an issued stop order.  To determine whether you have the right to appeal, please refer to the Municipal Government Act.   

Filing an Appeal

To file an appeal to the Subdivision and Development Appeal Board, submit a written Notice of Appeal including reasons, and the appeal fee to the Subdivision and Development Appeal Board no later than the final date for appeal as specified by the Municipal Government Act.

After an Appeal is Filed

Once an appeal is filed, a hearing will be scheduled within 30 days.  At least 5 days’ notice of the hearing will be given to those persons specified in the Municipal Government Act and the County’s Land Use Bylaw. 

The Board conducts its hearings in a manner that may resemble court proceedings.  The Board tries to keep the process informal, however procedures are set out to promote fairness for all parties.  The hearing and evidence submitted are public.    

Appeal Decisions

The Board will give its decision in writing together with reasons for the decision within 15 days after concluding the hearing. 

Court of Appeal

A decision of the Subdivision and Development Appeal Board may be appealed to the Court of Appeal on a question of law or jurisdiction.
